German employees have more formal rights than almost anywhere else in Europe, and most of them are exercised through a body that sits inside the company. Knowing its name and its powers changes what you can ask for.

The works council is not a union branch and not a management committee; it is an elected body with defined rights. The vocabulary is legal but small, and it appears in every staff notice and every contract of employment.

Labour law sets the floor and the Betriebsvereinbarung sets the local detail, which is why two branches of the same company can have different rules. A Tarifvertrag, where one applies, generally offers better terms than the legal minimum.

Any workplace with at least five permanent employees can elect a Betriebsrat, and its members are protected against dismissal while in office. The Betriebsversammlung is held quarterly, and it is the place where the workforce hears the figures directly.

On staffing, working time and data protection the works council has a genuine right of veto, and management must seek consent rather than inform afterwards. On closures and major reorganisations it must be consulted, and the Sozialplan it negotiates decides the compensation.

The notice period grows with length of service, and after six months the protection against dismissal applies in firms of more than ten employees. A formal Abmahnung must come before a dismissal for conduct, and it can be challenged.

A complaint in a German firm goes first to the manager, then to the works council, and only then outside the company. Writing down what was said, when and to whom is what makes a later escalation credible.

Unions negotiate sector by sector, and a Warnstreik is a short action used to press a claim rather than to shut the industry. Membership is voluntary, but only members are covered by the dispute payments that a long strike would require.

The equal treatment act covers age, sex, religion, disability, origin and sexual orientation, and a complaint has short deadlines. Where a works council exists, there is also a data protection officer and often a person specifically responsible for severely disabled colleagues.

A works council is elected every four years, and the size of the council grows with the number of employees, from one member in a small firm to dozens in a large one. The election is organised by an electoral board and paid for by the employer.

Its rights come in three strengths. It must be informed about planned changes, it must be consulted on staffing matters, and it holds a genuine right of co-determination on questions such as working hours, holiday rosters, overtime and the introduction of monitoring systems.

Where the employer and the council cannot agree, either side may call the Einigungsstelle, an arbitration committee chaired by a neutral person, and its decision can bind both parties.

The council meets the employer in the Betriebsversammlung, keeps minutes and posts them, and every employee is free to read them. Attending a works meeting during working time does not cost you any pay.

Members of the council enjoy special protection against dismissal, but the office itself is honorary and unpaid beyond the hours it takes.
